This Policy explains what cookies and similar technologies are, their currently confirmed status in the DCS Studio service and what rules will apply before new solutions are launched. As of the date of preparing this draft, within the currently verified scope of the service, no active cookies, browser storage used by the website, analytics tools or marketing technologies have been found. This status may change after new functions are implemented. Before publication, the document will be checked again against the actual operation of the final version of the service.

3. What cookies and similar technologies are

Cookies are small pieces of information stored on the user’s device or read from that device when using a website.

Similar technologies may include, among others, browser storage mechanisms such as localStorage, sessionStorage, IndexedDB or Cache Storage, as well as other solutions used to store information or access information located on the user’s device.

Such technologies may be used, for example, to ensure website operation, security, remembering settings, providing a function selected by the user, analytics or marketing. Each mechanism should be assessed according to its actual purpose and mode of operation.

4. Current status of technologies in the service

Within the currently verified scope of the service:

  • no active cookies were found;
  • no active localStorage, sessionStorage, IndexedDB or Cache Storage entries were found;
  • no active analytics, marketing technologies, tracking pixels or tools used to observe the user were found;
  • no active mechanism for saving emoji handling settings in browser session storage was found;
  • no connections to the external Google Fonts service were found;
  • no storage of a user’s cookie consent decision was found.

For this reason, there is currently no list of active cookies or their retention periods. This information concerns the currently verified scope of the service and is not a guarantee concerning all future versions of the website, subpages, language versions, devices or browsers.

5. Cookie banner and preferences panel

The cookie banner and preferences panel are not currently displayed because, in the verified state, no technologies requiring the user’s prior consent have been confirmed.

The user does not currently receive the choice “Accept”, “Reject” or “Preferences”, and the service does not store a consent decision.

The absence of a banner does not mean there is no obligation to provide clear information. This document explains the current status and the rules applied before new technologies are launched.

If a solution requiring consent is launched in the future, a mechanism will be implemented that enables consent to be given before activation and later easily withdrawn or changed.

6. Basic legal rules

Under Article 399 of the Polish Electronic Communications Law, storing information or gaining access to information already stored in the user’s device generally requires prior provision of clear, easy and understandable information and obtaining consent.

These requirements do not apply where the storage or access is necessary solely to transmit an electronic communication or to provide a service requested by the user.

Under Article 400 of the Electronic Communications Law, the provisions on personal data protection apply accordingly to obtaining consent.

If a given technology leads to the processing of personal data, the GDPR also applies, in particular the principles of lawfulness, transparency, purpose limitation and the obligation to provide the user with appropriate information.

7. Browser settings

The user may manage cookies and similar technologies through browser settings. The browser may allow, among other things, blocking cookies, deleting stored information, limiting selected mechanisms or informing about an attempt to store them.

Browser settings do not replace prior consent in a situation where consent is legally required on the service side.

Blocking a mechanism that is strictly necessary for the operation of a function selected by the user may affect the availability of that function.

8. Rules for launching new technologies

Before launching new cookies, browser storage, analytics, marketing, pixels, embedded media or external services, a renewed technical and legal assessment will be carried out.

The assessment should determine in particular:

  • whether the technology stores information on the user’s device or accesses it;
  • what its actual purpose is;
  • whether it is strictly necessary for a function expressly requested by the user;
  • whether it requires prior consent;
  • what data is processed, for how long and by which entities;
  • whether data is transferred outside the European Economic Area;
  • what information should be provided to the user.

Non-essential technologies, in particular analytics or marketing technologies, should not be launched before such an assessment is completed and an appropriate consent mechanism is implemented, if required.

9. Information retention period

In the currently verified state, no cookies or active entries in browser storage were found, so there is currently no list of retention periods for such mechanisms.

If cookies or similar technologies are launched in the future, the document will be supplemented with their name or function, purpose, responsible entity and duration of operation or criteria for determining that period.

10. Relationship with the Privacy Policy

The Cookie Policy is separate from the DCS Studio Privacy Policy.

The Privacy Policy describes broader rules for processing personal data, including the controller’s details, purposes and legal bases for processing, data recipients, retention periods and user rights.

This Policy describes the current status of cookies and similar technologies and the rules for reassessment before new mechanisms are launched. Both documents should be consistent with each other and reflect the actual operation of the service.

11. Update and re-verification

The Policy will be updated before new cookies, browser storage, analytics, marketing, embedded content or external providers are launched if the change affects the information provided to the user.

Before publication of the final version of the document, the actual operation of the final version of the service will be checked again, in particular the presence of cookies, browser storage, external connections, analytics, marketing and the consent mechanism.
